____________________________ being duly sworn, deposes and states the following:

1. That I am the fee owner of premises known as ____________________, in _________, County, New York, identified as tax lot ______ in Block ______ on the tax map of the City of New York for ________ County (the "Premises"), which Premises are the subject of a title report issued by the First American Title Insurance Company of New York ("First American") under its number _____________ to insure the transfer of my interest in said Premises to ____________________, and that I am familiar with all of the facts relating to the Premises.

2. There are no other tenants or persons in possession or having a right to possession of the Premises.

3. There are no vaults beneath the surface of the street(s) used in connection with the Premises.

4. I will proceed to have Sidewalk Violation No. __________ filed against the Premises in the office of the ________ County Clerk on _____________, discharged of record.

5. No judgment, parking violation judgment, or Environmental Control Board judgment listed in the title report is against me. They are against a person or persons with a similar name.

6. No work has been done upon the Premises by the City of New York and no demand has been made by the City for any work that may result in charges by the New York City Department of Environmental Protection for water tap closing or any related work or by the Department of Health.

7. All inspection fees and permit fees billed or to be billed for any period prior to closing by New York City’s Building Department and Fire Department have been or will be paid.

8. I will pay any water and sewer charges entered in the records of the City Collector or the New York City Department of Environmental Protection after closing which relate to a period prior to closing not presently entered by reason of there being either no water meter reading or only minimum, average or estimated water meter readings.

This affidavit is being made in order to induce First American to issue a policy of title insurance, and I hereby indemnify First American against any loss or damage, including reasonable legal fees and legal expenses, incurred by reason of First American’s reliance hereon.
