BOUNDARY AGREEMENT
AGREEMENT made this ____ day of ________ 19___ between _____________ , a New York Partnership having its principal place of business at ___________ New York ("Owner") and _________________ , a New York Partnership having its principal place of business at _______ __________________ , New York ("Adjoining Owner").
WITNESSETH
WHEREAS, Owner is the owner in fee simple of ___________________ and Adjoining Owner is the owner in fee simple of the adjoining premises ___________________ , both parcels situate in the City, County and State of New York; and
WHEREAS, the parties desire to fix and definitely establish the boundary line between the two parcels mentioned above respectively owed by them.
NOW THEREFORE, in consideration of the premises and of the sum of one dollar by each of the parties hereto to the other in hand paid, the receipt of which is acknowledged, the parties, for themselves, their successors and assigns, covenant and agree that the boundary line be established as a line described as follows:
The Reference Line shall be that line beginning at a point formed by the intersection of the northerly side of __________ Street with the westerly side of __________ Avenue and running northerly, along the wester1y side of ____________ Avenue ___ feet _____ inches to a point.
The Boundary Line shall begin at the most northerly point of the Reference Line and proceed westerly along a line formed by an interior angle of ___ degrees ___ minutes ____ seconds with the Reference Line, ____ feet to a point.
WHICH Boundary line is shown on the survey of ____________________ dated ___________ .
AND Owner revises, releases and quitclaims to Adjoining Owner and its assigns forever right, title and interest in and to any land lying to the south of the Boundary Line so established and, Adjoining Owner revises, releases and quitclalms to Owner and its assigns forever right, title and interest in and to any land lying to the north of the Boundary Line so established.
IT IS MUTUALLY AGREED AND COVENANTED that this agree-ment shall run with the land and be binding upon and ensure to the benefit of the successors in interest of the parties.
IN WITNESS WHEREOF, the parties have set their hands and seal on the day and year written above.
